Who can apply for the L-1 visa?
L-1 visa is a non-immigrant visa that allows employees working for companies with headquarters located in the United States and abroad.
This visa will allow employees to relocate to the corporation’s US office only after successfully completing a year of the three years preceding the transfer.
Employees must be related to the U.S. company in either of the below-mentioned ways:
- Parent and subsidiary
- Branch and Headquarters
- Sister companies owned by the mutual U.S. Company
- Affiliates owned by the U.S. Company
Types of L-1 visa
The L-1 visa is divided into subcategories:
First L-1A : This visa application is open to executives and managers and valid up to 7 years.
Second L-1B: This visa application is open to workers with special skills and valid up to 5 years.
Types of L-1 visa procedure
There are two types of L-1 visa procedure:
First L-1 Regular visa : This visa must be applied and approved by the USCIS.
Second L-1 Blanket visa : This is an Intra company Transferee visa that an individual can file a petition at the U.S. consulate or embassy, along with copies supporting their personal qualifications.
What is the L-1 visa application process?
Step 1 – Complete and submit the non-immigrant application form DS-160 to the State Department online.
Step 2 – File a petition with the USCIS by filling the form I-129 along with supporting documents.
Please note: Applicants who are already in the United States can request a change of status while filling the form I-129.
Step 3 – L-1 petitioning employer should then submit the application fee.</>
Step 4 – Lastly, submit form I-797 Notice of Action showing the approval of the visa will be issued at the U.S. consulate or embassy.
Can I change my L1- visa type?
Yes, you can!
In order to move into the managerial or executive position, L-1B status can be changed to L-1A status. But, this can be only after 7 years of service in the L-1b status.
You will have to inform the USCIS at least 6 months prior to reaching the 5-year maximum period in the L-1B status.
What is the renewal process for L-1 visa application?
L-1 Regular visa can be renewed and extended within the United States, however, in the case of L-1 Blanket visa – a new petition has to be applied via Form I-129.
Renewals are being processed at the U.S consulate or embassy outside the United States.
